Abstract of Content
In introduction, the author expounds “the significance of study of legal value ”. In his opinion, the study of legal value is beneficial to remedy the defects in the law and jurisprudence, to promote the rational level of the law and legal science, to face up to the human subject status in the law and jurisprudence, to enrich the means of study of legal science and to conduce to the formation of axiology in law. Chapter one is named “the concept of legal value”. Through discussing the meaning of viewpoints of value, value and axiology, and analyzing different definitions of legal value, the author puts forward and proves his own standpoint on the definition, the attributes, the existing forms, and the significance of legal value. Chapter two, “the system of legal value”, elucidates the meaning, the system structure, the subject structure, the criterion structure, the state structure, the function structure, the measurement structure and the tense structure of the system of legal value, and analyzed its conditions from many aspects. Chapter three, “the subject of legal value”, discussed the relationship between human being, human nature, human needs and legal value. Chapter four, “the conflict of legal value”, probes into the manifestation of, cause of and solution to legal value’s conflict, and the ways and importance to solve the conflict. The last chapter is concerns “the realization of legal value” where the thesis dissertated the signification, conditions, obstacles, impetuses, manners and measurement of the realization of legal value. |
